Collaborative Law
We are trained collaborative family lawyers. Collaborative law is an alternative way for divorcing or separating couples to work together to resolve family disputes. The aim of collaborative law is to look for practical and amicable solutions to family issues without involving the Court.
The collaborative law process
At the heart of the process is the belief that an honest and respectful approach to resolving differences leads to better outcomes. The collaborative process creates a safe environment in which, with the benefit of independent legal advice, you can negotiate a resolution and avoid the aggravation, delay and considerable expense of litigated Court proceedings.
How does collaborative law work?
You will each appoint a collaborative lawyer.
There is prompt, honest and open disclosure of all information
Settlement is reached in a series of four way meetings in order to work things out face to face.
You will be encouraged to find creative and individual solutions tailored to your family's circumstances.
Once agreement has been reached this will be submitted to the Court for approval and made into an order.
What are the advantages of collaborative law approach?
You can maintain control of the process by participating at each stage.
You can avoid misunderstandings and unnecessary arguments which may otherwise occur if negotiation is conducted via correspondence.
You can retain a positive relationship for the future.
You can avoid potentially acrimonious, stressful and protracted Court proceedings.
You can make decisions and avoid the uncertainty of a Court imposed outcome.
You can focus on fixing the problem and not apportioning blame.
Is collaborative law for everyone?
It is not for everyone but should be considered.
